Spanking - Whose Fault?

So, an American woman gets awarded $1.7 Million in damages & compensation for she was Spanked. I'm not going to argue on the way the case got settled, but the way the case got started.

Now, everyone has to understand that the company (whichever is involved) has some team building practices - Eat baby food, wear diapers & get spanked on butt - (officially or unofficially) if a sales team loses. Everyone in the teams should understand this and should take this sportively. If at all, there is an objection to it, shouldn't we raise the same on the first place? This lady, if she is feeling so uncomfortable, she should have put her opinion forward and if things still happen, then she has all rights to take up this issue with court.

As a side note, I'm not sure about the actual history of this issue, but these things do surprise me. The way these kind of issues are handled in developed countries. People have all the time and money in the world to put up a case against a company stating mental agony, sexual harassment etc, for which the court takes like one or two years to settle with millions & millions of dollars.
Like last year, I guess, someone had called up the producers of 'Fear Factor' into a court case, because the 'someone' went on puking after seeing people eat rat in the show. Now, who asked you to see that?
